Terms of Service

1. Your Use of the Services

You must be at least 18 and able to form a binding contract. You may use the Services only for lawful purposes and in accordance with these Terms.

You are responsible for:

• The accuracy of information you provide.
• Deciding which letters or documents to send and to whom.
• Complying with applicable laws, deadlines, and procedures in your jurisdiction.

We do not contact lenders or servicers on your behalf. We do not negotiate your loan.

2. No Legal, Tax, or Financial Advice

All content, calculators, templates, and outputs are for educational purposes. They are not a substitute for professional advice. Consult a qualified attorney, housing counselor, accountant, or licensed loan officer as needed.

3. Accounts & Access

You may need an account to use certain features. Keep your credentials confidential. You are responsible for all activity under your account.

We may suspend or terminate access for any violation of these Terms, suspected fraud or abuse, or to protect the Services.

4. Purchases & Refunds

Certain features (e.g., an "Action Pack" of templates) may require payment. Prices are shown at checkout and may change.

Refunds: Because our products are digital and delivered instantly, purchases are generally non-refundable. If you experience a technical issue preventing access, contact contact@danielmedia.agency within 7 days and we'll make reasonable efforts to resolve it or, at our discretion, provide a refund.

Payments are processed by a third-party provider (e.g., Stripe) and are subject to their terms.

5. Intellectual Property

We own the Services, including site design, text, software, logos, and content, excluding your own content and third-party materials. We grant you a personal, limited, non-exclusive, non-transferable license to use the Services and download the documents you generate for your own personal, non-commercial use.

You may not:

• Copy, distribute, or modify the Services, except as permitted by law.
• Reverse engineer or attempt to extract source code.
• Use the Services to build a competing product.

6. Your Content

You retain ownership of information you submit. You grant us a limited license to host, process, and display your content to provide and improve the Services. You represent that you have all rights necessary to submit your content.

7. Prohibited Conduct

You agree not to:

• Use the Services in violation of any law or regulation.
• Misrepresent your identity or your relationship with any person or entity.
• Interfere with security, integrity, or performance of the Services.
• Upload malware or harmful code.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT RESULTS WILL BE ACCURATE OR RELIABLE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $50.

Some jurisdictions do not allow certain exclusions or limitations; some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless LP Benjamin Daniel and our affiliates, officers, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your content, or your violation of these Terms or applicable law.

11. Third-Party Services

The Services may integrate with or link to third-party products (e.g., hosting, analytics, email, payments). We are not responsible for third-party content, policies, or practices.

12. Changes to the Services or Terms

We may modify the Services or these Terms at any time. If changes are material, we will notify you by updating the date above and/or providing additional notice. Your continued use after changes constitutes acceptance.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflicts of law rules.

Informal Resolution. Before filing a claim, you agree to email contact@danielmedia.agency with a description of the dispute and allow 30 days to try to resolve it informally.

Arbitration & Class Waiver. Except for small-claims court, any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by a recognized provider under its rules. You and we waive any right to participate in a class action or class-wide arbitration. You may opt out of arbitration within 30 days of first use by emailing contact@danielmedia.agency with subject "Arbitration Opt-Out" and your name and account email.

Venue for any permitted court proceedings will be in San Diego County, California.

14. Termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms, to protect the Services, or as required by law. Sections that by their nature should survive termination (e.g., IP, disclaimers, limitations, indemnity) will survive.
